Services

Creative Mind Events-Crafts & More shall provide Client with the agreed services and/or products in a contract/proposal that must be signed by

Creative Mind Events-Crafts & More and client before any services are preformed. 

Delivery of Services (Events)

Creative Mind Events-Crafts & More will provide all Services on requested date and time unless otherwise specified in this Agreement.  When the provided Services are tied to the number of guests that Client expects to attend Client's event, Client agrees to notify Creative Mind Events-Crafts & More with an accurate guest count. 

Delivery, Shipping & Pickup (Orders)

Shipping is available on selective items and products in and out of states. Shipping cost will be added to quotes and final invoice. Average shipping cost starts at $13.95 and up based on weight and quality. Delivery is available at $20 up to 15 miles and additional $5 per every 2 miles from zip code 60560. Pickup is available and FREE of charge.

Delivery & Pickup Time

Pickup is only available Monday - Saturday 11 am - 7 pm. (times may vary, but client will be notified) Pickup location is 1427 Cannonball Trail, Yorkville, IL. 60560  Unless you have spoken with Creative Mind Events-Crafts & More personal and made other arrangements.

Delivery is Available every Friday; delivery hours are from 9-1 pm. A email will be sent to setup a delivery time 2 days prior.

Please note that as a Client of Creative Mind Events-Crafts & More; when placing an order it is solely the client's responsibility to retrieve placed orders.  Creative Mind Events-Crafts & More offers client's 3 options:

• Free Pickup (refer to Delivery & Pickup time above for scheduled day and time) 
• Paid delivery (Based on mileage)
• Paid shipping/handling 
  

After 7 days and order has still not been retrieved by client a storage fee of $5 a day will apply and any abandon orders will be resold.

Cost, Fees and Payment

Cost. The total cost ("Total Cost") for all Services is due in full two weeks prior to client's events. Client shall pay the Total Cost to Creative Mind Events-Crafts & More as follows: Via Paypal, CashApp , Cash or Money Order. No Personal Checks.  The invoice section will auto-populate with your Payment Schedule.  The first payment is a non-refundable retainer. At a minimum, Client agrees that the retainer fee fairly compensates Vendor for committing to provide the Services and turning down other potential projects/clients.

Exclusivity

Exclusivity. Client understands and agrees that he or she has hired Creative Mind Events-Crafts & More exclusive of any other service provider. In order to provide a high level of satisfaction and quality of service, no other service providers, other than any assistant or third party that Creative Mind Events-Crafts & More hires to complete the Services outlined in this Agreement, are permitted to provide the same or similar services or products, paid or unpaid, at the locations and dates specified in this Agreement.

Intellectual Property

Copyright Ownership. In the event that any copyrighted work(s) are created as a result of the Services provided by Creative Mind Events-Crafts & More in accordance with this Agreement, Creative Mind Events-Crafts & More  owns all copyrights in any and all work(s) it creates or produces pursuant to federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered. Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling this Agreement, are expressly and solely owned by Creative Mind Events-Crafts & More  and may be used in the reasonable course of Creative Mind Events-Crafts & More's business.

Permitted Uses of Product(s). Creative Mind Events-Crafts & More  grants to Client a non-exclusive license of product(s) produced with and for Client for personal use only so long as Client provides Creative Mind Events-Crafts & More with attribution each time Client uses Creative Mind Events-Crafts & More property. Personal use includes, but is not limited to, use within the following contexts:

• In photos on Client's personal social media pages or profiles; or
• In personal creations, such as a scrapbook or personal gift; or
• In personal communications, such as a family newsletter or email or holiday card.

Artistic Release

Style. Client has spent a satisfactory amount of time reviewing Creative Mind Events-Crafts & More work and has a reasonable expectation that

Creative Mind Events-Crafts & More will perform the Services in a similar manner and style unless otherwise specified in this Agreement.

Consistency. Creative Mind Events-Crafts & More will use reasonable efforts to ensure Client's desired Services are produced in a style and manner consistent with

Creative Mind Events-Crafts & More's current portfolio and Vendor will try to incorporate any reasonable suggestion made by Client. However, Client understands and agrees that:

• Every client and event is different, with different tastes, budgets, and needs;
• Planning services are often a subjective art and Vendor has a unique vision, with an ever-evolving style and technique;
• Creative Mind Events-Crafts & More will use its artistic judgment when providing Services for Client, which may not include strict adherence to Client's suggestions;
• Although Creative Mind Events-Crafts & More will use reasonable efforts to incorporate Client's suggestions and desires when providing Client with the Services, Creative Mind Events-Crafts &  More shall have final say regarding the aesthetic judgment and artistic quality of the Services;
• Dissatisfaction with Creative Mind Events-Crafts & More's aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.

Limit of Liability

Maximum Damages. Client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by Creative Mind Events-Crafts & More.

Loss of Product. In the event that any or all product(s) are lost, such as damage to or loss of a component of the product necessary for final delivery, Creative Mind Event-s Crafts & More shall refund Client a pro-rated portion of the Total Cost based on the amount of Services that were completed/provided against the amount of Services that were agreed to be completed/provided.

Indemnification. Client agrees to indemnify, defend and hold harmless Creative Mind Events-Crafts & More and its affiliates, employees, agents and independent contractors for any injury, property damage, liability, claim or other cause of action arising out of or related to Services and/or product(s) Creative Mind Events-Crafts & More provides to Client.

Apparel Order & Payment Terms 

Payment or Deposit required to start an order (non-refundable). Accept cash, PayPal and Cash App payments ONLY. Quotes are valid for 7 days. Turnaround time once the quote and artwork is approved, after payment is received turnaround time is approximately 4-7 business days. Depending on our schedule, we can also offer rush services for those that need their orders sooner at an additional cost. Please submit these requirements at least 7 business days prior to your deadline. If we do not receive these requirements within the time frame, your order is subject to be delayed.

Requirements:

• Finalized Artwork
• Finalized Garment Selection (style, quantity, size, and colors)
• Payment

Clients are responsibility: Throughout the process of an order, various issues can pop up regarding the artwork or garments that you will need to address. (For example: if a certain garment color is out of stock, we would contact you and ask for an alternative option.) If we do not hear from you and do not resolve these issues in a timely manner, the turnaround time can be subject to delays. In cases where our distributors have back ordered or discontinued certain garments, we can offer substitute garments for the out of stock items, or we can wait until the stock is replenished. Please keep in mind that turnaround time may be affected, resulting in delays. Artwork with every order, we will provide a digital mock up and 1 revision. If additional mock ups are needed, the hourly artwork fee will be applied. It is the customer's responsibility to check the mock up for any misspellings or other errors. This especially applies to designs that have a list of names. If everything looks right, please confirm with us that the artwork is ready for print.  If we do no hear from you in a timely manner, the turnaround time can be subject to delays. 

Digital mock ups give a general idea of what the product will look like, but do not exactly translate to the final product. If you have specific dimensions, Pantone colors, and print placement details in mind, please let us know. With these parameters, we will do our best to get as close as possible. If these details are not given to us, we may use our best judgment and will not be held responsible. No return policy for all sales are final. Only replacement accepted for damaged products only! ie bad prints, damaged shirts. Replacements will not be accepted for size exchanges. Please notify us via email with any concerns. 

Liquor Bottles Order Terms

All liquor bottle glasses, goblets, shooters, candles, ashtrays, lamps and baskets payment is due at time order is placed. For larger orders half of balance is due at time of order and is not refundable.

• Pricing is the same for cut of bottle(s) even if you are providing your own bottle(s).
  

• Custom labeling and wording is not included an additional $5 will apply. (i.e Happy Birthday, Name, Date).
  

• All sales are final once bottles are cut.

Cancellation, Rescheduling and No-Shows

Cancellation, Rescheduling of Services or No-Show Client. If Client desires to cancel Services, reschedule Services, or if it becomes impossible for Creative Mind Events-Crafts & More to render Services due to the fault of the Client or parties related to Client, such as failure of the event to occur or failure of one or more essential parties to the event to show up in a timely manner, Client shall provide notice to Creative Mind Events-Crafts & More as soon as possible via the Notice provisions detailed in this Agreement. Creative Mind Events-Crafts & More has no obligation to attempt to re-book further Services to fill the void created by Client's cancellation, rescheduling, no-show or if it becomes impossible for Creative Mind Events-Crafts & More  to provide the Services due to the fault of Client (or parties related to Client), and Creative Mind Events-Crafts & More  will not be obligated to refund any monies Client has previously paid towards the Total Cost. Client is not relieved of any payment obligations for cancelled Services, rescheduled Services, failing to show up for the Baby shower, or should it become impossible for Creative Mind Events-Crafts & More to provide the services due to the fault of Client (or parties related to Client) unless the Parties otherwise agree in writing. For instance, if Creative Mind Events-Crafts & More is able to secure another, unrelated client for , then Creative Mind Events-Crafts & More may choose, at its sole discretion, to excuse all (or a portion of) Client's outstanding balance of the Total Cost. 

Refunds & Credits

Creative Mind Events-Crafts & More hereby reserves and retains the right to cancel any and all Services and or orders with or without cause by providing written notice to Client. In the event Creative Mind-Events-Crafts & More elects to terminate this Agreement, half of the Retainer Deposit will be refunded to Client within thirty (30) days of notice of termination via Cashier check.  Any cancellations due to an outside vendor that Creative Mind Events-Crafts & More has hired for services for your event will receive either a full refund within (30) days or credit equal to the amount with Creative Mind Events-Crafts & More ; Creative Mind Events-Crafts & More will determine the appropriate refund based off the services that were cancelled.

Impossibility

Force Majeure. Notwithstanding the above, either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to:

• A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or
• War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not); or
• Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.

Failure to Perform Services. In the event Creative Mind Events-Crafts & More cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:

• Immediately give Notice to Client via the Notice provisions detailed in this Agreement; and
• Issue a refund or credit based on a reasonably accurate percentage of Services rendered; and
• Excuse Client of any further performance and/or payment obligations in this Agreement.

General Provisions

Governing Law. The laws of Illinois govern all matters arising out of or relating to this Agreement, including torts.

Severability. If any portion of this Agreement is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force.

Notice. Parties shall provide effective notice ("Notice") to each other via either of the following methods of delivery at the date and time which the Notice is sent:
